Terms of Service

These Terms of Service ("Terms") govern your access to and use of electionske.com (the "Platform", "we", "us", or "our"), a campaign website builder for candidates seeking elected office in Kenya. By creating an account or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

If you are creating an account on behalf of a candidate, party, or agency, you confirm that you are authorized to accept these Terms on that party's behalf.

1. Who Can Use the Platform

1.1. You must be at least 18 years old to register an account.

1.2. You must register using a valid Safaricom mobile number, which we verify by SMS one-time code before your account is activated.

1.3. Candidate accounts are limited to one active campaign page at a time. Agency accounts (for campaign managers, consultants, and communications firms) may manage multiple candidate campaign pages under a single login.

1.4. You are responsible for keeping your login phone number and password confidential, and for all activity that occurs under your account. Notify us immediately at support@electionske.com if you suspect unauthorized access.

2. What the Platform Does

The Platform lets you build and publish a public campaign website (candidate profile, manifesto, track record, events, media gallery, and a "how to donate" page displaying your own M-Pesa or bank details), collect volunteer sign-ups and messages from site visitors, and send bulk SMS to your own contacts using SMS credit you purchase.

We do not process, collect, or hold campaign donations on your behalf. Any M-Pesa Paybill/Till number, bank account, or other donation details you display on your page belong to you, and funds sent by supporters go directly to you, not through electionske.com. We are not a party to, and accept no responsibility for, any donation transaction between you and your supporters.

3. Free Trial, Subscription Fees, and Billing

3.1. New campaigns start with a free trial period (currently 7 days), during which your campaign page and dashboard are fully accessible.

3.2. After the trial ends, continued access requires an active paid subscription. Subscription pricing varies by the office you are contesting (MCA up to President) and by billing package (monthly, quarterly, semi-annual, or annual), as shown on our pricing page.

3.3. Subscriptions are paid via M-Pesa STK Push and do not renew automatically. If your subscription lapses, your public campaign page and dashboard access are suspended until you renew — your data is retained and access is restored immediately once payment is confirmed.

3.4. All subscription fees are quoted in Kenya Shillings (KES) and are non-refundable except where required by law or at our discretion in cases of a verified platform error.

3.5. Prices may change from time to time. Changes will not affect a subscription period you have already paid for.

4. Bulk SMS and Contact Data

4.1. SMS credit is purchased separately via M-Pesa STK Push into your campaign's SMS wallet and is spent as you send messages. SMS wallet balances are non-refundable and non-transferable between campaigns.

4.2. You are solely responsible for the phone numbers you upload or add to your contact groups. By uploading a contact, you confirm that you have a lawful basis to message that person (for example, they are a supporter, volunteer, or otherwise expects to hear from your campaign) and that your use of the Platform to message them complies with applicable Kenyan law, including data protection and consumer protection rules.

4.3. We may require you to apply for and use an approved sender ID for outgoing messages, and may reject or suspend a sender ID application at our discretion (for example, if it is misleading or impersonates another person or organization).

4.4. We reserve the right to suspend bulk SMS sending on any account we reasonably believe is being used to send unsolicited, harassing, deceptive, or unlawful messages.

5. Your Content and Conduct

5.1. You are solely responsible for the accuracy and legality of everything you publish on your campaign page, including your biography, manifesto, achievements, event listings, and any media you upload.

5.2. You must not use the Platform to publish or send content that:

  • is false, defamatory, or misleading about yourself or any other candidate or person;
  • incites violence, hatred, or discrimination on the basis of ethnicity, religion, gender, or any other protected characteristic;
  • violates any applicable electoral law or regulation, including rules issued by the Independent Electoral and Boundaries Commission (IEBC);
  • infringes another person's intellectual property, privacy, or other legal rights; or
  • is otherwise unlawful under the laws of Kenya.

5.3. Compliance with campaign finance disclosure, electoral conduct, and any other obligations placed on you as a candidate or political actor under Kenyan law remains entirely your responsibility. The Platform is a website and communications tool only — it does not provide legal, electoral, or compliance advice.

5.4. You retain ownership of the content you upload. By publishing content on the Platform, you grant us a license to host, display, and transmit it as necessary to operate the service (for example, serving your public campaign page, or sending your SMS messages through our SMS gateway partner).

6. Party Branding

If you select a political party affiliation, your page may automatically adopt that party's colors and symbol for display purposes. This is a visual convenience only and does not imply endorsement by, or affiliation confirmation from, the party in question — you are responsible for accurately representing your own party membership or candidacy status.

7. Suspension and Termination

7.1. You may stop using the Platform at any time. Contact support@electionske.com if you would like your account or campaign data deleted.

7.2. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or if required to do so by a competent authority.

7.3. On termination, your public campaign page will be taken offline. We may retain account and campaign records for a reasonable period afterward as described in our Privacy Policy, including for legal, tax, and record-keeping purposes.

8. Service Availability

We aim to keep the Platform available and reliable, but we do not guarantee uninterrupted or error-free service. Features that depend on third-party providers (such as M-Pesa payments or SMS delivery) may occasionally be delayed or unavailable due to circumstances outside our control.

9. Disclaimers and Limitation of Liability

9.1. The Platform is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Platform's fitness for a particular purpose, including its use for electoral campaigning.

9.2. To the fullest extent permitted by law, electionske.com's total liability to you for any claim arising from your use of the Platform is limited to the amount you paid us in subscription and SMS fees in the three (3) months preceding the claim.

9.3. We are not liable for indirect, incidental, or consequential losses, including loss of votes, donations, or campaign opportunity, arising from your use of or inability to use the Platform.

10. Indemnification

You agree to indemnify and hold electionske.com harmless from any claim, loss, or liability (including reasonable legal costs) arising from your content, your use of the Platform, your violation of these Terms, or your violation of any law or third party's rights.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify active account holders (for example, by SMS, email, or an in-app notice). Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya.
